5 estate planning techniques to get you started protecting your loved ones and your assets

Death is inevitable and it’s vital to protect the future of your loved ones. Anything can happen to you that might leave you incapable of doing anything. You can be paralyzed or be put in a coma due to some accident. Any sort of mishappening can mean that your loved ones can be exposed to an uncertain future. They might not have any money as most of their money would be stuck in your account. If not that, your property and other belongings which are essential to your family’s well-being can be at the risk of being seized by the bank or taken away by a lot of other people. Fights over property between family members are also common after one’s death. Things can turn very ugly very quickly. It’s important to ponder over such things and take the necessary steps today to avoid such grievances towards your family.

Taking care of all such things is collectively called estate planning and these days a lot of stress is being put on its importance. Though there are a lot of things that estate planning entails, there are a few important ones that you should keep on priority.

Drafting a will

Drafting a will is basically writing a document that gives direct and clear instructions on what to do with the possessions, assets, or money that you have. It is not necessary that a will is made only if you are rich or if you have many assets to give ahead. This document, if written before the demise, needs to be consistent with legal bonds and arrangements that are outside the will. For example, you can not give a car that is owned by someone else to your child.

It is also important to make sure that the will should contain stepwise happenings of all the processes to do away with any quarrels and disagreements between your family when you are not there. Any complications in your will can lead to different members of your family or loved ones contesting the will which can lead to ugly fights and legal cases against each other.

Power of Attorney

Power of attorney is a crucial document. It helps the deceased or the incapable to have a representative during any complication. If you do not draft a proper power of attorney all the important decisions would be left to the court. This would result in a lot of decisions that you would not have wanted. To avoid such things it is necessary to have an attorney handling all the legal actions that happen after your demise or even better, you could contact a dependable estate planning service for easier functionalities that would facilitate the power of attorney for you.

Such power of attorneys can be discontinued by the principal as and when they like. This usually happens when the actual principal is capable of making their own decisions or upon death. Many times the family members take charge and set up a reciprocal power of attorney. But it is not always necessary that this should happen. At times like these, it is better to have a family member or some other trusted person to become the agent. This person should be financially savvy in order to make the right decisions in the family’s favor.

Beneficiary Declarations

As explained earlier all of the possessions that you have are supposed to be passed on to your family members and loved ones. IF you do not have a will where you mention the exact names and the exact possessions to pass on to them, the court will do it for you. We have also already explained that the court can take matters into its own hands and pass on property and possessions to people you would never have opted for. To avoid such situations it is vital to name beneficiaries very carefully and give detailed explanations of the assets that are supposed to go to them. According to experts at sheppard insurance Another thing that you need to take care of is declaring the contingent beneficiary. This is because there is a chance that your initial beneficiary may also face death or may be rendered incapable of handling the assets passed onto him/her. In such a case you should take steps in advance to plan out the transfer of possessions to the next person. If you do not do so the court may have to get involved and make the decisions for you. Not declaring the contingent beneficiary can also result in quarrels between the family members, an angle which has also already been discussed.

All the beneficiaries that you declare need to be of age, i.e. they should be above the age of 21 and should be competent to handle the possessions passed onto them. Your insurances and other such documents should also have detailed descriptions of beneficiaries and contingent beneficiaries as they also play a  huge role in the drafting of the will.

The letter of Intent

Just to make things clear, the letter of intent is not taken as a valid document in the eyes of the law. This letter is simply an informal document that gives out specific information on certain matters after the demise. It could contain specific instructions to the beneficiary of a property as to what to do with it. It could also contain specific instructions on certain things like the funeral and certain rituals that are needed to be included in it. So, all in all, it is basically a letter to the loved ones where you can give certain instructions about topics that are related to you and if you were alive, people would have taken your advice on.

All of these factors are probably the most important in such cases and should be considered by everyone who will be leaving something for their loved ones. Estate planning is crucial in today’s date as the number of cases of family disputes over ancestral property and wealth is increasing by the day. The fear of matters being dealt with by the court is also a huge factor that should push you to start thinking about estate planning ASAP. Go through the aforementioned points to get yourself started on such crucial matters.
