AUSTIN – Leading an 11-state coalition, Texas Attorney General Ken Paxton today filed a friend-of-the-court brief with the U.S. Supreme Court declaring States’ interest in cooperating with the federal government on immigration law, and promoting respect for human life. The brief supports the U.S. Department of Health and Human Services (HHS). In a previous lawsuit, HHS alleged that the American Civil Liberties Union lawyers representing Jane Doe, an unlawfully-present minor alien in federal custody in Texas, misled the government in order to arrange an abortion for the minor.
“No court has ever before recognized such broad rights for unlawfully-present aliens with virtually no connections to the country,” Attorney General Paxton wrote in the brief. “Under the reasoning of the courts below, there will be no meaningful limit on the constitutional rights an unlawfully-present alien can invoke simply by attempting to enter this country.”
Texas filed the amicus brief with Arkansas, Kentucky, Louisiana, Michigan, Missouri, Nebraska, Ohio, Oklahoma, South Carolina, and West Virginia.
